AUDI Aktiengesellschaft, the owner of AUDI trademark claimed a writ against the owner of AUDI.RU domain. The writ was claimed to admit management of AUDI.RU domain in the Russian Internet section as the infringement of the claimant right to exclude others for AUDI  trademark.

Jaminy Limited, the owner of the domain name, had rights for AUDI.RU domain since 1999. There was not placed any information on the website, however there was a redirection to another website where cars of different brand and spares for them are offered for sale.

The claimant provided the court evidence that a respondent used his trademark illegally.  AUDI Aktiengesellschaft representatives, basing on the trademark legislation, claimed to prohibit use of AUDI  trademark in the domain name.  The trial regarding AUDI.RU domain was proceeded for more than two years. Such an impressive period is caused by the duration of the procedure of the official notification of foreign legal entities. Another reason is that the domain owner wanted to avoid a trial procedure.
